New Year, New Job?

If you are starting the new year with a new job, make sure you know what you are signing if you are presented with an employment contract. Many times, employers will include non-compete agreements that can be enforceable even if you are later terminated without cause.

Similarly, if you are thinking about leaving your current position, it is important to know what you have already agreed to. Often, employment agreements or separation agreements will include confidentiality and non-disparagement clauses.

As we have covered before, North Carolina does not have a statute dealing with non-compete agreements, but instead enforceability is determined by case law. The law changes or is refined regularly and we keep up with those changes to help guide and advise our clients.

If you are presented with an employment or separation agreement, have a lawyer review it so that you know exactly what you are agreeing to and whether or not it is enforceable.
